When you visit our Platform and interact with others using our Platform Wimt collects personal data for the purposes described in section 3. You can learn more about what personal data Wimt collects below.
When setting up an account you need to provide Wimt with certain information about yourself. This data may include your first name, last name, date of birth, gender, geographical location, email-address, phone number and other contact details.
You may also upload personal data to your user profile. Depending on the choices you make, this data may include photos, information about your interests, preferences and skills.
Personal data may also be included in the content you share in your feed, or in posts or text messages that you publish or send when using the Platform.
Wimt collects personal data related to your use of the Platform. Such data may include technical information such as your IP-address and other data necessary to identify you as a user. Wimt may also collect data concerning the date and time of logins and logouts from the Platform, as well as data concerning user activities such as visited pages, posts, likes, comments, replies, reviewed media etc.
When other users of the Platform send messages and post content, they may share your personal data with Wimt. This data may include your name, photos, videos and any personal data that another user chooses to share about you.
Information about your device, account and this app related to the issue that you are reporting will be automatically included in the report in order to help us understand and resolve the issue. This includes information such as user activity, logs, network logs, crash logs and memory dumps associated with the Wimt app. We will not use the information contained in this report for other purposes.
To enhance your user experience, Wimt offers the ability to upload photos from your photo library. We request this permission only after you have actively chosen to use a feature that requires uploading photos.
How We Use Your Photos:
The photos you choose to upload are used solely to perform the service or function you have requested.
We do not store your photos longer than necessary to provide the service.
Sharing with Third Parties:
We do not share photos from your photo library with third parties without your explicit consent, except as required by law.
Control and Choices:
You can change the app’s access to your photo library at any time through the settings on your device.
You can choose not to upload photos and still use other parts of the app.
Below you will find a description of the purposes for which your personal data are being processed by Wimt. Please note that if your personal data have been collected for processing for a particular purpose, Wimt is prevented from processing your data for other purposes, which are incompatible with the purpose for which the data were initially collected.
Wimt processes your personal data to be able to provide and administer the Platform and all its features. It is necessary for Wimt to process your personal data to enable you to use the Platform, i.e. to set up your account, allow you to log-in, and enable you to create and post content and messages. Wimt may also process your personal data to adapt the content in your feed to better suit your preferences and interests and for the purpose of improving, optimising and further developing the Platform and its features.
Personal data are also processed for the purpose of administering user accounts and accounts for organisations and official brands.
Wimt also processes personal data to be able to perform necessary technical support of the Platform and to enhance the security and stability of the Platform.
Wimt needs to process your personal data to be able to communicate with you, i.e. to handle customer support cases and to provide you with other assistance you may need in connection with your use of the Platform.
Certain profiles and pages on the Platform may contain ads and directed advertising. Wimt may process your personal data for the purpose of directing such ads and advertising to you, based on your user activities, your likes and interests.
Wimt processes your personal data for the purpose of improving, optimizing and further developing the Platform and its functions.
Wimt will process your personal data for the purpose of complying with legal obligations to which Wimt is subject. Wimt may, for example, process your personal data to be able to administer user accounts in accordance with the GDPR, for example to manage requests for registry extracts or for the deletion of user accounts and associated data.
Currently cookies are not used in the platform.
Under applicable data protection legislation, any processing of personal data must be based on a legal basis. The legal bases for the processing of personal data performed by Wimt in the context of the Platform are described below.
Wimt processes your personal data based on the fact that the processing is necessary for the performance of a contract to which you are subject, i.e. the Terms and Conditions under which Wimt provides the Platform and its features, provided that your user account is personal (and not for an organisation or an official brand). The Terms and Conditions which constitute the contract between you and Wimt is also the legal basis for the processing of personal data which Wimt performs to enable you to use the Platform, to perform support of the Platform and to provide you with customer support on your request. For example, your agreement with Wimt constitutes the legal basis for processing of personal data which is necessary for:
registration, onboarding, login;
enabling you to join and leave communities and group channels; and
administration of customer support cases.
Wimt also processes personal data based on its own legitimate interests and based on the legitimate interests of third parties. Such legitimate interests include Wimt’s interest to develop, optimise and improve the Platform, Wimt’s interest to enable other users to view your content (depending on the privacy settings you have selected), to enable you and other users to communicate using the Platform, Wimt’s interest to enable interactions like the creation of posts, comments, likes and replies and Wimt’s interest to ensure that the Platform is a safe environment for all users and that hostile and offensive content can be removed when necessary.
In the event that your user account is for an organisation or an official brand, the legal basis for any processing necessary for the registration and administration of the account, and for providing the Platform and its features, as well as any technical support and customer support, is Wimt’s legitimate interest to perform these tasks.
Wimt collects your consent for processing of personal data for direct marketing purposes within the framework of the Platform. You can always choose to decline to give your consent to processing activities which require your consent. If you decline to give your consent, Wimt will refrain from the processing activities concerned.
You are entitled to withdraw your consent at any time by contacting Wimt using the following contact details:
Wimt will process your personal data when it is necessary for compliance with a legal obligation to which Wimt is subject. Wimt may, for example, process your personal data to the extent that it is necessary for compliance with a decision of a competent authority or to the extent that processing of your personal data is necessary to ensure the safety of other users of our Platform.
Wimt will store your personal data for as long as is necessary for the purposes of the processing, for example to provide the Platform and to comply with legal obligations to which Wimt is subject.
Personal data related to your user account, such as your profile and personal data contained in text messages and content you have shared on the Platform will be stored for as long as you have a user account and for an additional period of one year.
Certain data may be stored for longer periods of time when it is necessary for the purpose of complying with legal obligations, for example under mandatory data retention laws or to follow a binding decision from a competent authority.
Other users of the Platform will be able to access personal data which you share on your profile or which you post to the Platform, for example when you make a comment to a video posted by someone else or when you generate and post content which contains your personal data.
Wimt may give its service providers access to your personal data to the extent that such access is necessary for the service providers to be able to carry out their services on behalf of Wimt, for example to carry out technical support of the Platform and to provide the technical infrastructure of the Platform. Any access to personal data by service providers will be covered by agreements which contain binding provisions on confidentiality and data processing.
Wimt may disclose your personal data when it reasonably deems that it is necessary or that it has an obligation to do so under applicable legislation, a binding authority decision or for the purpose of other legal process.
Your personal data will be stored on servers located within the EU. Your personal data may, however, be transferred to countries outside of the EU/EEA, for example when your personal data are accessed by Wimt’s staff or service providers in countries outside of the EU/EEA.
Wimt has personnel in Ukraine and Brazil who are responsible for the maintenance of the data in the production environment. Any transfers of or access to your personal data by Wimt’s personnel outside of the EU/EEA will be covered by the standard contractual clauses adopted by the EU Commission as well as supplemental safety measures (if deemed necessary by Wimt).
Amazon Web Services provides the servers on which your personal data will be stored. The servers are located in Ireland. Certain elements of Amazon’s services may, however, entail that your personal data are transferred to a country outside of the EU/EEA. Any transfer of your personal data will be performed in accordance with the applicable data protection legislation and will either be to a country or region which is subject to an adequacy decision by the EU Commission, or will be covered by appropriate safeguards, such as the standard contractual clauses adopted by the EU Commission as well as supplemental safety measures (if deemed necessary).
You are entitled to a number of rights under applicable data protection legislation. Wimt, in its capacity as controller of the personal data, is responsible for ensuring that you are able to enforce those rights. Wimt is committed to facilitating any request you may have to enforce rights under applicable data protection legislation. Below follows a description of your data protection rights.
You have the right to receive information about the processing of your personal data in a concise, transparent, clear and easily accessible form. As a main rule, you are entitled to receive information on the action taken by Wimt regarding a request for information within one month of Wimt’s receipt of the request.
You are also entitled to obtain from Wimt a confirmation as to whether or not personal data concerning yourself are being processed, and, where that is the case, you also have the right to access the personal data. You can contact Wimt and ask Wimt to provide you with information about the processing and ask for a copy of your personal data free of charge.
You are also entitled to receive a copy of personal data which you have provided to Wimt in a structured, commonly used and machine-readable format and to request Wimt to transmit such data to another controller, provided that the processing of the personal data concerned is based on your consent or on a contract between you and Wimt.
You have the right to obtain from Wimt without undue delay the rectification of inaccurate personal data concerning yourself. If personal data are incomplete, you are also entitled to have personal data completed.
Please note that you may also rectify inaccurate personal data yourself, i.e. by editing your user account information.
Wimt will delete personal data following a request for erasure provided that the request is founded under the applicable data protection legislation. You have the right to erasure of your personal data provided that:
the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; or
the processing is based on your consent, and you withdraw your consent and there is no other legal basis for the processing; or
you object to the processing in accordance with section 8.5 below and, where applicable, there is no overriding legitimate grounds for the processing; or
the personal data have been processed unlawfully; or
the personal data have to be erased for compliance with a legal obligation to which Wimt is subject; or
the personal data have been collected in relation to the offer of information society services directly to a child.
Please note that you may also be able to delete your personal data yourself, i.e. by deleting posts, text messages, or information you have entered on your user profile.
Wimt will restrict the processing of your personal data following your request provided that the request is founded under the applicable data protection legislation. You have the right to restriction of processing in the following circumstances:
for a limited period enabling Wimt to verify the accuracy of your personal data if you have contested the accuracy of the personal data; or
if the processing is unlawful but you have opposed to the erasure of the personal data and have requested the restriction of their use instead; or
Wimt no longer needs the personal data for the purposes of the processing but you require the data for the establishment, exercise or defense of legal claims; or
for a limited period enabling Wimt to verify whether the legitimate interests of Wimt override your interests if you have objected to the processing pursuant to section 8.5 below.
You are entitled to object to the processing of your personal data for the purpose of Wimt’s, or a third party’s, legitimate interests.
In the event that you object to processing of your personal data, Wimt will evaluate whether there are compelling legitimate grounds for the processing of your personal data which override your interests, rights and freedoms. Wimt will also investigate whether Wimt needs to keep your personal data for the establishment, exercise or defence of legal claims.
Please note that you are always entitled to request that Wimt ceases to process your personal data for direct marketing purposes and that Wimt will cease such processing as soon as possible following your request.
You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or otherwise significantly affects you.
The right not to be subject to automated individual decision-making does not apply to the extent that the decision is based on your explicit consent, or to the extent that it is necessary for entering into, or for the performance of, a contract between yourself and Wimt.
